Matters Arising Not Covered in the Agenda

 

 

4.1

A report on the disposal of Poor’s Piece was read out (D1464). The price paid was £14,000 by Mrs Calvert of Ross-on-Wye. The Trustees have invested the monies received (£11,828 after costs of sale) in Charity Investment Funds – Income Bonds which are currently yielding 3.61% net of Tax. These funds are managed by CCLA and will be added to the existing account.

Traffic Speeds and Management Within the Parish

 

 

5.1

The Chairman reported on the meeting of 23rd November with Andrew Lee-Jones of CHDC. 20mph limits by schools are being introduced. A 30mph limit for Linton can be considered. The Roadmaker junction will be altered. Other matters are also under consideration.

 

 

5.2

A parishioner outlined his particular safety problem and suggested that a mirror would help. He was asked to submit a proposal to the Clerk who will carry it forward.

Lengthsman Project

 

 

6.1

Andy Tector, Head of Environmental Health & Trading Standards at CHDC, spoke on the subject of Fly Tipping and explained that central government waste management rules mean that the Lengthsman should not clear fly tipping. He should report all incidents to the appropriate CHDC Officer (usually John Dowson) who will arrange for collection. This will normally happen within two to three days although vehicles can take much longer.

Cllr Richard Smith asked if the collector was a CHDC employee or a contractor. Answer: A contractor.

 

 

6.3

Cllr John Foley asked whether all incidents are recorded and whether all items are collected. Answer: Yes to both.

 

 

6.4

Cllr John Foley asked which roads come under CHDC for Fly Tipping. Answer: All roads except motorways which come under the Highways Agency.

 

 

6.5

The Clerk asked whether litter collection is affected. Answer: No, the Lengthsman should continue with that.

 

 

6.6

The Chairman thanked Mr Tector for taking the time to come and speak to us.

Proposed by Cllr Richard Smith, seconded by Cllr Rob Crawford and approved by 5 votes to three, IT WAS AGREED to accept the Lengthsman’s quote of £100 to cut the allotment hedge and clear the cuttings.

Cllr John Wheble said that on a previous occasion he had asked to see the Lengthsman’s time sheets but had only received the Clerk’s summary. Copies of the originals will be provided at the next meeting.

Allotments Gate and Water Supply

 

 

7.1

Parishioner Elena Beaumont has requested an allotment, having discovered the availability via the internet and the Council’s website. Her cheque for £10 to cover the balance of the year has been received. She requests that she be allowed to keep a few chickens on the allotment and erect a suitable hut. Council readily agreed.

Work on the water supply is in-hand and allotment holders present were content. Work on the gates has not yet started.

Budget for 2005/6

 

 

8.1

Proposed by Cllr Richard Smith, seconded by Cllr Ken Downham and approved unanimously, IT WAS AGREED to set the precept for 2005/2006 at £8,180. The Clerk will so inform CHDC.

Emergency Plan

 

 

10.1

Council seeks to approve the plan at the next meeting in January. Cllrs Richard Smith and Jean Foley will be the liaison officers. The Clerk will seek other volunteers prior to the next meeting.

Accounts, Treasurer’s Report and Authorisation of Payment of Accounts

 

 

11.1

A letter from Lloyds Bank (D1471), received just on the deadline given by Council for a response, makes it clear that the originally proposed automatic transfers between accounts will be too costly. Council has been offered £50 compensation for lost interest and decided to accept that. In future, the Clerk will use his best endeavours to make transfers between accounts, so as to maximise interest received.

Cllr John Foley has advised the Area Rights of Way Office at CHDC of the proposed holiday apartment development at Hartleton Water and in particular of the impact this would have on the recently established “Ross Round Walk”.

12.2.1

P127. DCSE2004/3036/F. Proposed extension to bar. The Roadmaker, Gorsley, HR9 7SW. Permission granted on 18/10/04.

 

 

12.2.2

P134. DCSE2004/3744/RM. Erection of one dwelling. Plot adjacent to Lovers Walk, Quarry Lane, Gorsley, HR9 7SJ. Revised drawing received on 26/11/04. no further action.

 

 

12.2.3

P131. DCSE2004/3726/O. Site for erection of 2 executive houses. Burrups Lane (Old Brandon's Poultry Site), Gorsley. Copy letter of objection received from Mrs J Bennet.

 

 

12.2.4

P136. DCSE2004/3950/O. Site for two storey, four bedroom house with detached single garage, parking and driveway. Land adjacent to Brokendean, Gorsley, HR9 7SW. Council does not support.

 

Although the site is within the settlement boundary it is too small for residential use and would be considered 'cramming'.  Another access onto the busy B4221 at this point would be dangerous.  It does not therefore fulfil the criteria of a windfall site.

 

 

12.2.6

P137. DCSE2004/3958/F. Construction of 44 holiday apartments. Hartleton Farm, Bromsash HR9 7SB. Copies of Parishioner’s objections have been received. Council has never before seen such a scale objection from Parishioners to a planning application. Cllr Jean Foley will be submitting Council’s formal objection as follows:

Linton Parish Council has resolved to make the following comments:-

The Parish Council does not support this application for the following material planning considerations:-

1.  This development would seriously conflict with, and be a departure from, Planning Policies TM1, TM5, and TM6 of the South Herefordshire Development Plan.

2.  It would also be a departure from Planning Policies RST1, RST12, RST14 in the emerging Herefordshire Unitary Development Plan.

3.  It would be impossible to ensure that all vehicles entered the development via the entrance envisaged on the plans.  Therefore extra traffic would be generated along a very narrow lane, without passing places. The Highway Authority should be consulted with regard to the increase in traffic, access and road safety.

4.  A Public Footpath runs through this site and has just been included in a new recreational walking route around Ross.  This would not be compatible with a development of this size and character and the vehicular traffic which it would generate.

5.  We have noted that the draft Supplementary Planning Guidance - Landscape Character Assessment of September 2002 has defined this site on Figure 12 Map of Landscape Management Objectives as an area for conservation and enhancement, the development would not aid this objective.  The Landscape Officer has also advised us that there will be no alterations to this assessment in the final SPG.  Therefore any consideration of this application should include an Environmental and Landscape Character Assessment.

6.  By law, decisions have to be made in accordance with the development plan unless other material considerations indicate otherwise.  It is considered that this application is an over development of the site which is in contravention of all relevant planning policies and should therefore be refused.
